INTELLECTUAL PROPERTY RIGHTS

I, Cengiz Gürtusgil, want to make clear that Sama Deploy and all its components - including but not limited to the source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (which I'll refer to as the "Content"), along with all trademarks, service marks, and logos (the "Marks") - are my exclusive intellectual property, either owned directly by me or licensed for my use. This intellectual property is protected under copyright and trademark laws, as well as various other intellectual property rights and unfair competition laws across multiple jurisdictions and international conventions. When you access Sama Deploy, the Content and Marks are provided "AS IS" and are intended solely for your personal information and use. Without my explicit written permission, you may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or exploit any part of Sama Deploy, including its Content or Marks, for any commercial purposes.

If you meet the eligibility requirements to use Sama Deploy, I hereby grant you a restricted license to access and use the platform. This includes permission to download or print portions of the Content that you've legitimately accessed, but only for your personal, non-commercial purposes. I explicitly retain all rights to Sama Deploy, the Content, and the Marks that are not specifically granted to you through these Terms of Use.

USER REPRESENTATIONS

When you use Sama Deploy, you acknowledge and confirm that: (1) any registration details you provide will be truthful, precise, up-to-date, and comprehensive; (2) you commit to keeping this information accurate and will update it promptly when needed; (3) you possess the legal capacity to agree to and follow these Terms of Use; (4) you have reached at least 13 years of age; (5) you are either of legal age in your jurisdiction or have obtained parental consent to use Sama Deploy; (6) you agree not to employ automated means, including bots or scripts, to access Sama Deploy; (7) you will only use Sama Deploy for legal and authorized purposes; and (8) your usage of Sama Deploy will comply with all relevant laws and regulations.

Should you submit any information that is false, inaccurate, outdated, or incomplete, I, Cengiz Gürtusgil, reserve the right to suspend or terminate your account and deny you access to Sama Deploy, both presently and in the future.

FEES AND PAYMENT

I, Cengiz Gürtusgil, accept the following payment methods for Sama Deploy:

• Google Pay
• Apple Pay
• Link

To access certain services on Sama Deploy, you may need to make a purchase or pay a fee. You agree to provide accurate and complete purchase and account information, including current email address, payment details, and card expiration dates. You also agree to promptly update this information to ensure I can process your transactions and contact you when necessary. For purchases made through Sama Deploy, I will bill you via an online billing account. I reserve the right to add applicable sales tax to purchase prices as required. All payments must be made in EURO, and I may adjust prices at my discretion.

By making a purchase, you agree to pay all applicable charges at the current prices and authorize me to charge your selected payment method for the full amount.

I process all payments securely through Stripe.com payment services.

I retain the right to correct any pricing errors or mistakes, even after payment has been requested or received. Additionally, I reserve the right to decline any order placed through Sama Deploy at my discretion.

CANCELLATION

I, Cengiz Gürtusgil, provide Sama Deploy as a one-time, lifetime access purchase. When you buy Sama Deploy, you will not be charged any recurring fees or monthly subscriptions. Once payment is completed, the lifetime access purchase becomes permanent and is generally non-refundable.

To ensure customer satisfaction, I provide a 48-hour evaluation period following your initial payment. During this time window, if you find that Sama Deploy does not meet your expectations, you may contact me for a full refund. Please note that once this 48-hour period expires, I will not be able to process any refund requests, as this is a permanent lifetime access purchase.

PROHIBITED ACTIVITIES

I, Cengiz Gürtusgil, provide Sama Deploy for you to use in your projects and businesses. However, there are certain restrictions on how you may use the service to protect both my intellectual property and other users.

As a user of Sama Deploy, I prohibit you from:

• Collecting or scraping data from Sama Deploy to create any kind of database or directory without my explicit written consent.
• Using automated means to create accounts or gather user information like email addresses for sending unsolicited communications.
• Engaging in deceptive practices to obtain sensitive information, such as passwords, from other users or myself.
• Abusing the support services I provide or submitting false reports.
• Transferring or selling your user profile to others.
• Pretending to be another person or using someone else's username.
• Using information from Sama Deploy to harass or cause harm to others.
• Creating a competing service based on Sama Deploy or attempting to replicate its functionality.
• Attempting to reverse engineer or decompile any part of Sama Deploy's software.
• Trying to circumvent any access restrictions or security measures I have implemented.
• Harassing or threatening me or any of my employees who help maintain Sama Deploy.
• Copying or adapting Sama Deploy's source code, including but not limited to PHP, HTML, JavaScript, CSS, or any other programming elements.
• Uploading or attempting to upload any malicious code, including viruses or Trojan horses, or engaging in activities that disrupt the normal operation of Sama Deploy.
• Using any form of tracking mechanisms, including but not limited to web beacons, pixels, cookies, or similar technologies, to collect information without authorization.
• Taking actions that could damage my reputation or that of Sama Deploy.
• Using Sama Deploy in ways that violate applicable laws or regulations.
• Reselling, redistributing, or attempting to sublicense access to Sama Deploy.

SUBMISSIONS

When you provide any questions, comments, suggestions, ideas, feedback, or other information regarding Sama Deploy ("Submissions") to me, Cengiz Gürtusgil, you acknowledge and agree that these Submissions are non-confidential and will become my sole property. I will own all exclusive rights, including intellectual property rights, and I am entitled to use and share these Submissions without restriction for any legal purpose, whether commercial or otherwise, without needing to acknowledge or compensate you.

By submitting, you waive all moral rights to these Submissions and warrant that they are either your original work or that you have proper rights to submit them. You agree that you will not take any legal action against me for any claimed or actual infringement or misappropriation of any proprietary right related to your Submissions.

THIRD-PARTY WEBSITES AND CONTENT

While using Sama Deploy, you may encounter links to external websites ("Third-Party Websites") or come across various content elements like articles, images, videos, software and other materials that originate from third parties ("Third-Party Content"). I, Cengiz Gürtusgil, want to make it clear that I do not verify, monitor, or review such Third-Party Websites and Third-Party Content for accuracy, suitability, or completeness. I take no responsibility for any Third-Party Websites that you may access through Sama Deploy or any Third-Party Content that is posted on, available via, or installed from Sama Deploy. This includes but is not limited to the content quality, accuracy, views expressed, reliability, privacy practices, or other policies contained within these Third-Party Websites or Content.

When I include links to, or allow the use or installation of Third-Party Websites or Content on Sama Deploy, this does not mean I endorse or approve of them. Should you choose to leave Sama Deploy to visit Third-Party Websites or use Third-Party Content, you do so at your own discretion and risk, understanding that these Terms of Use will no longer apply. I strongly recommend that you carefully review the terms, policies, and data collection practices of any external website you visit from Sama Deploy or any applications you choose to install.

I, Cengiz Gürtusgil, want to emphasize that any purchases you make through Third-Party Websites are transactions between you and those third parties - I am not involved in these transactions in any way. You acknowledge that I do not endorse any products or services offered on Third-Party Websites, and you agree to hold me harmless from any damages resulting from your purchases of such products or services. Furthermore, you agree to hold me harmless from any losses or harm you may experience that relate to or result from any Third-Party Content or your interactions with Third-Party Websites.

U.S. GOVERNMENT RIGHTS

Sama Deploy's services qualify as "commercial items" under Federal Acquisition Regulation ("FAR") 2.101. For non-Department of Defense ("DOD") agencies acquiring our services, these Terms of Use apply in accordance with FAR 12.212 (computer software) and FAR 12.211 (technical data). For DOD agencies, these Terms of Use apply per Defense Federal Acquisition Regulation ("DFARS") 227.7202-3, with DFARS 252.227-7015 governing technical data. This U.S. Government Rights clause takes precedence over any other FAR, DFARS, or similar provisions addressing government rights to software or technical data under these Terms.

SERVER MANAGEMENT

I, Cengiz Gürtusgil, want to clarify that neither I nor Sama Deploy bear any responsibility for charges applied to your payment methods by third-party server providers, including but not limited to those listed as mine partners or any other providers you may use in conjunction with Sama Deploy.

Furthermore, I explicitly state that I assume no liability for any security incidents or data breaches that may occur on servers managed through Sama Deploy. While I strive to provide reliable tools through Sama Deploy, I cannot and do not guarantee the security of any servers that you provision or manage using the platform. You acknowledge and accept full responsibility for the security of any servers you operate through Sama Deploy.

SITE MANAGEMENT

As the operator of Sama Deploy, I, Cengiz Gürtusgil, maintain certain rights while not being obligated to: (1) oversee and monitor Sama Deploy to ensure compliance with these Terms of Use; (2) pursue appropriate legal measures, at my discretion, against those who violate these Terms of Use or applicable laws, which may include reporting violations to relevant authorities; (3) at my sole judgment and without any limitations, deny access to, restrict, or deactivate (where technically possible) any Contributions you make; (4) remove or disable, without prior notice or liability, any content that places excessive burden on Sama Deploy's systems or exceeds reasonable size limits; and (5) administer Sama Deploy in ways that safeguard my intellectual property and ensure the platform's optimal performance.

PRIVACY POLICY

I, Cengiz Gürtusgil, take the protection of your data and privacy seriously. I encourage you to read my Privacy Policy available on the Sama Deploy website. Your use of Sama Deploy indicates acceptance of my Privacy Policy, which forms an integral part of these Terms of Use. I want to inform you that Sama Deploy's servers are located in Germany. By continuing to use Sama Deploy from any location outside Germany, including but not limited to the European Union, Asia, or other regions with different data protection laws, you explicitly agree to the transfer and processing of your data in Germany under German law.

Additionally, I am committed to protecting young users. I neither deliberately collect information from children nor target them in my marketing efforts. In compliance with the U.S. Children's Online Privacy Protection Act, should I become aware that personal information has been collected from anyone under 13 years old without verified parental permission, I will promptly remove such data from Sama Deploy's systems.

TERM AND TERMINATION

As long as you continue using Sama Deploy, these Terms of Use remain binding and effective. I, Cengiz Gürtusgil, maintain the absolute right to restrict or deny access to Sama Deploy and revoke any licenses at my own discretion, without any prior notification or liability. This includes my ability to block specific IP addresses and deny service to any individual, regardless of reason. Such actions may be taken in response to violations of these Terms of Use, breaches of applicable laws or regulations, or for any other reason I deem necessary. Furthermore, I retain the authority to terminate your license and delete any associated information at any time, without warning, based solely on my judgment.

Should I, Cengiz Gürtusgil, find it necessary to revoke your license, you must understand that you are strictly forbidden from making new purchases to obtain another license, whether under your own name, an alias, a pseudonym, or even through a third party's identity - regardless of whether you have their permission. Beyond license termination, I explicitly reserve the right to pursue any appropriate legal remedies, including but not limited to civil litigation, criminal prosecution, and injunctive relief.

MODIFICATIONS AND INTERRUPTIONS

I, Cengiz Gürtusgil, maintain the right to alter, adjust, or eliminate any content within Sama Deploy as I see fit, at any moment and for any purpose, without prior notification. While I strive to keep Sama Deploy current, I am not obligated to update its content. Furthermore, I retain the authority to modify or cease operations of Sama Deploy, either partially or entirely, without advance notice. I will not accept responsibility to you or any other parties for such modifications, pricing adjustments, temporary suspensions, or complete discontinuation of Sama Deploy.

As the operator of Sama Deploy, I must emphasize that continuous availability cannot be guaranteed. Technical difficulties, maintenance requirements, or other circumstances may lead to service interruptions, delays, or technical issues. I reserve the right to implement changes, updates, or modifications to Sama Deploy whenever necessary, without prior notification. By using Sama Deploy, you acknowledge and accept that I, Cengiz Gürtusgil, bear no responsibility for any losses, damages, or inconveniences you may experience due to service unavailability or interruptions. Additionally, these Terms of Use should not be interpreted as creating any obligation for me to provide ongoing maintenance, support, updates, or modifications to Sama Deploy.

GOVERNING LAW

The legal relationship between you and me, Cengiz Gürtusgil, regarding your use of Sama Deploy is exclusively governed by and interpreted under German law. These Terms of Use and all agreements are to be fully performed within Germany, regardless of any principles of legal conflict that might otherwise apply.

ONLINE DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (ODR platform) which can be accessed via http://ec.europa.eu/consumers/odr. This platform serves as a point of entry for out-of-court resolutions relating to contractual obligations arising from online sales contracts. We are neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board, however, we remain committed to resolving any disputes directly with you in a fair and amicable manner.

RESTRICTIONS

I, Cengiz Gürtusgil, and you agree that any arbitration proceedings will be strictly limited to addressing disputes between us individually. Under applicable law, I want to make clear that: (a) arbitration cannot be combined with other proceedings; (b) disputes cannot be arbitrated as class actions or using class action procedures; and (c) no disputes may be brought claiming to represent the general public or other individuals.

EXCEPTIONS TO ARBITRATION

In my agreement with you regarding Sama Deploy, certain disputes are exempt from the arbitration requirements outlined above. These specifically include: (a) any disputes related to protecting or enforcing my intellectual property rights, or questions about their validity; (b) disputes involving claims of theft, privacy violations, piracy, or unauthorized usage; and (c) requests for injunctive relief. Should any part of this provision be deemed legally unenforceable, neither I, Cengiz Gürtusgil, nor you will pursue arbitration for disputes falling under the unenforceable portion. Instead, such disputes will be resolved through the appropriate courts as specified in the jurisdiction section above, and both parties agree to accept the personal jurisdiction of these courts.

CORRECTIONS

I acknowledge that Sama Deploy may occasionally contain typographical errors, inaccuracies, or omissions in its content, including but not limited to descriptions, pricing, and availability information. As the operator of Sama Deploy, I, Cengiz Gürtusgil, maintain the right to correct such errors, address inaccuracies, and remedy omissions, as well as update any information on Sama Deploy whenever necessary, without providing prior notification.

DISCLAIMER

I, Cengiz Gürtusgil, provide Sama Deploy on an as-is and as-available basis. You acknowledge and agree that your use of Sama Deploy is at your sole risk. To the fullest extent permitted by law, I disclaim all warranties, whether express or implied, regarding Sama Deploy and your use thereof, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I make no guarantees or representations regarding the accuracy or completeness of Sama Deploy's content or any linked websites. Furthermore, I assume no liability or responsibility for: (1) any content errors, inaccuracies, or mistakes, (2) personal injury or property damage resulting from your access to and use of Sama Deploy, (3) unauthorized access to my secure servers and any stored personal or financial information, (4) service interruptions or transmission cessation, (5) any malicious software, viruses, or similar threats that may be transmitted to or through Sama Deploy by third parties, and/or (6) any content errors or omissions, or any damages incurred from using content made available through Sama Deploy. I do not warrant, endorse, or guarantee any third-party products or services advertised or offered through Sama Deploy, any linked websites, or any advertising content. I will not monitor or be responsible for any transactions between you and third-party service providers. As with any online service or product, I strongly advise you to exercise appropriate caution and judgment.

LIMITATIONS OF LIABILITY

Under no circumstances will I, Cengiz Gürtusgil, be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including but not limited to lost profits, revenue, data, or other damages arising from your use of Sama Deploy, even if I have been made aware of the possibility of such damages. Regardless of any contrary provisions in these terms, my liability to you for any cause whatsoever, and regardless of the form of action, will always be limited to any amount you have paid to me, if applicable. Please note that certain jurisdictions do not allow limitations on implied warranties or the exclusion of certain damages. If these laws apply in your jurisdiction, some or all of the above disclaimers or limitations may not apply to you, and you may be entitled to additional rights.

INDEMNIFICATION

You commit to defend, indemnify, and protect me, Cengiz Gürtusgil, including any affiliated parties, officers, partners, agents, and employees, against any claims, damages, liabilities, or demands, including reasonable legal fees, made by third parties arising from: (1) your usage of Sama Deploy; (2) any violation of these Terms of Use; (3) breach of any warranties or representations outlined in these Terms; (4) infringement of third-party rights, particularly intellectual property rights; or (5) any deliberate harmful actions toward other Sama Deploy users you've interacted with through the platform. Despite the above, I, Cengiz Gürtusgil, maintain the right to take control of the exclusive defense of any matter requiring your indemnification, at your expense. You agree to collaborate with my defense of such claims, covering any associated costs. I will make reasonable attempts to inform you of any claims, actions, or proceedings subject to this indemnification upon my awareness of them.

USER DATA

As the operator of Sama Deploy, I will store and maintain certain data you transmit to manage the platform's performance and track your usage patterns. While I implement regular data backup procedures, you retain full responsibility for all data you transmit or generate through your activities on Sama Deploy. I, Cengiz Gürtusgil, explicitly state that I bear no liability for any data loss or corruption, and by using Sama Deploy, you waive any right to take legal action against me arising from such data loss or corruption.

ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By accessing Sama Deploy, sending emails to me, and filling out online forms, you engage in electronic communications. You agree to receive electronic communications and acknowledge that all agreements, notices, disclosures, and other communications I, Cengiz Gürtusgil, provide electronically, whether via email or through Sama Deploy, fulfill any legal requirements for written communication. YOU EXPLICITLY CONSENT TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AS WELL AS THE ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND TRANSACTION RECORDS INITIATED OR COMPLETED BY ME THROUGH SAMA DEPLOY. You hereby relinquish any rights or requirements under any laws, regulations, rules, or statutes in any jurisdiction that would otherwise require physical signatures, non-electronic records, or non-electronic payment methods.

MISCELLANEOUS

The Terms of Use presented here, along with any policies or operating rules that I, Cengiz Gürtusgil, post on Sama Deploy, represent the complete agreement between you and me. Should I not exercise or enforce certain rights or provisions within these Terms of Use, this does not constitute a waiver of those rights or provisions. These Terms of Use are enforced to the maximum extent allowed by law. I retain the right to transfer any or all of my rights and obligations regarding Sama Deploy to others at any time. I cannot be held responsible for losses, damages, delays, or failures to act that occur due to circumstances beyond my reasonable control. If any part of these Terms of Use is found to be unlawful, void, or unenforceable, that specific portion can be separated from the Terms without affecting the validity and enforceability of the remaining provisions. Through these Terms of Use or your use of Sama Deploy, no joint venture, partnership, employment, or agency relationship is established between you and me, Cengiz Gürtusgil. You acknowledge that these Terms of Use cannot be interpreted against me simply because I drafted them. Additionally, you agree to waive any defenses related to the electronic format of these Terms of Use or the absence of physical signatures from both parties.
